Governor Greg Abbott has issued an executive order instructing several state agencies to take steps aimed at restricting the sale of hemp-derived products to minors in Texas. The move follows the Texas Legislature’s decision not to enact a ban on selling such products to individuals under 21.

“Texas will not wait when it comes to protecting children and families,” said Governor Abbott. “While these products would still benefit from the kind of comprehensive regulation set by the Texas Legislature for substances like alcohol and tobacco, my executive order makes sure that kids are kept safe and parents have peace of mind now, and that consumers know the products they purchase are tested and labeled responsibly.”

Under the new directive, the Department of State Health Services (DSHS) and Alcoholic Beverage Commission (TABC) must prohibit sales of hemp-derived products to minors. Retailers will be required to verify government-issued identification at the point of sale; failure to comply could result in loss of license.

The DSHS is also tasked with reviewing its current rules regarding hemp product sales. This includes considering revisions such as stronger testing and labeling requirements, higher licensing fees for improved enforcement, and better recordkeeping for oversight purposes.

Additionally, DSHS, TABC, and the Department of Public Safety (DPS) are ordered to work together with local law enforcement agencies across Texas to boost enforcement efforts related to hemp product sales.

The order also calls for TABC, DSHS, Texas A&M AgriLife Extension Service, and other entities to study a more comprehensive regulatory model based on House Bill 309. The proposed framework aims to establish a transparent system that addresses misuse while maintaining legal access for adults.
